
Administrative powers - Differences about the possibility of delegating police power

The main objective of this book is the analysis of administrative powers, as well as the existing differences in doctrine and jurisprudence regarding the possibility of delegating one of them, that is, the police power. the main powers exercised by the Public Administration. Thus, the concepts and foundations of some of these mechanisms that facilitate administrative activity will be addressed, such as, for example, discretionary power, regulatory power, hierarchical and disciplinary power. Subsequently, with the aim of giving greater emphasis to the subject, the second chapter specifically discusses the power of the police. This is one of the main prerogatives conferred on the Administration, aiming at its innumerable forms of realization in society. Finally, due to the recent turnaround in the jurisprudence of the Superior Courts, the different positions existing in administrative doctrine and judicial decisions regarding the possibility of delegating police power to private entities were brought up. With regard to the methodology used, at first, the relevant legislation was analyzed, as well as the main doctrines in administrative law and scientific articles that deal specifically with the subject.
